2. Definitions

• “User” / “You” means any visitor to the Website, registrant, enrollee, parent/guardian, participant or purchaser of any GKCI service.

• “Services” include coaching programs, camps, events, personal coaching sessions, online content, and related activities delivered by GKCI.

3. Acceptance & Modification of Terms

1. By accessing the Website or registering for any GKCI service you confirm that you have read, understood and accepted these Terms.

2. GKCI may modify these Terms at any time by posting the amended Terms on the Website. Your continued use after changes indicates your acceptance of the revised Terms. It is your responsibility to review the Terms periodically.

4. Eligibility & Registration

1. Use of certain services (including joining programs) may be limited by age or other eligibility criteria. Minors (below 18 years) must be registered by a parent or legal guardian who accepts these Terms on their behalf.

2. You must provide accurate, current and complete registration details. You agree to promptly update your information if it changes.

5. Programs, Booking & Payment

1. Program details, schedules and fees are published on the Website or provided at booking. GKCI reserves the right to change program timings, coaches, schedules or fees, with reasonable notice where possible.

2. Payment of fees must be made as instructed during registration. All payments are in Indian Rupees (INR) unless specified otherwise. GKCI uses third-party payment gateways; you agree to any terms of those gateways.

3. GKCI is not a bank or payment provider. We only facilitate payment collection through authorised channels. Any payment disputes must be raised with GKCI and, where applicable, with your payment provider.

6. Refund, Cancellation & Transfer Policy

1. Standard Policy: Unless explicitly stated for a specific program or campaign, GKCI’s general policy is no refunds once a program fee has been paid and the enrolment confirmed.

2. Transfers & Rescheduling: At GKCI’s discretion, transfers to another batch or program may be permitted subject to availability and administrative charges. Requests must be made in writing to operations@garykirstencricketindia.in.

3. Exceptional Circumstances: In rare circumstances (e.g., program cancellation by GKCI), a full or partial refund may be offered or a credit may be issued for future programs. Decisions are at GKCI’s sole discretion.

4. Always check specific program terms, promotional offers, or event policies which may contain alternate refund rules.

7. Code of Conduct, Safety & Equipment

1. Participants must follow GKCI’s code of conduct and safety instructions. Parents and guardians must ensure participants arrive with appropriate kit and protective equipment where required.

2. GKCI reserves the right to suspend or terminate participation for misconduct, unsafe behaviour, or non-compliance with instructions, without refund.

3. Participants must disclose any medical conditions, injuries or special requirements during registration. GKCI may require a medical clearance for participation in certain programs.

8. Assumption of Risk & Liability

1. Cricket and physical training involve risk. By enrolling, you (or the parent/guardian) acknowledge these risks and accept personal responsibility for any injury or loss that may occur.

2. To the fullest extent permitted by law, GKCI, its affiliates, employees, coaches and agents are not liable for any indirect, incidental, consequential, special or punitive damages, or for personal injury, death, loss or damage to property arising from participation in GKCI activities, except where caused by gross negligence or willful misconduct of GKCI.

3. You agree to indemnify and hold harmless GKCI from any claims, liabilities, damages, losses or expenses arising out of your breach of these Terms or your negligent acts or omissions.

9. Image, Video & Media Release

1. GKCI may photograph or record sessions, matches, events and training for promotional, training and archival purposes. By participating you grant GKCI a royalty-free, perpetual licence to use such images and recordings in any media.

2. If you do not consent to media use, please notify GKCI in writing at operations@garykirstencricketindia.in prior to participation. Subject to operational feasibility, GKCI will endeavour to accommodate reasonable requests.

10. Intellectual Property

1. All content on the Website (text, graphics, logos, images, videos, course material) is owned by GKCI or licensed to GKCI and is protected by intellectual property laws.

2. You may not reproduce, distribute, modify, create derivative works, or publicly display any content from the Website without prior written consent from GKCI. Personal, non-commercial use is permitted if content is unmodified and credit is given.

11. Website Use & Prohibited Conduct

1. You agree to use the Website in a lawful manner and not to engage in activities that may harm the Website, users, or GKCI’s interests (including uploading malicious code, spamming, impersonation, infringement of others’ rights).

16. Governing Law & Dispute Resolution

1. These Terms are governed by the laws of India.

2. Any disputes arising out of or relating to these Terms shall be resolved first by amicable negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra, India.
